In accordance with Article 25, 32, 38 and 73 of the KBF Disciplinary Regulation and Article 40 of the KBF Competition Regulation, also in accordance with the proposal with Reference No. 183, dated 19.05.2015, the Disciplinary Commission, on 21.05.2015 issued the following:
DECISION
Basketball Club “Peja”, from Peja, is suspended from the competitions of the ETC Super League and relegated to a lower level of competition, respectively to the Men’s First League of Kosovo.
The team is fined 2,000.00 € (two thousand Euros). The fine shall be paid to the official bank account of the Kosovo Basketball Federation.
A period of one year ineligibility in exercise of functions is imposed on Mr. Gazmend Pupovci, official representative of BC Peja.
Reasoning:
Disciplinary Commission received the proposal of the Competition Commissioner, Ref. No. 183 of 19.05.2015, to order BC Peja to pay a fine of 3,000.00 euros and suspend it from the competitions of the ETC Super League and demote it to a lower level of competition, for refusing to continue the second half of the game which took place on 18.05.2015 at 20:00hrs between BC “Sigal Prishtina”, from Prishtina, and BC
“Peja”, from Peja. Also, the proposal requested the initiation of disciplinary proceedings against Mr. Gazmend Pupovci, official representative of BC Peja.
On 20.05.2015, the Commission, in accordance with Article 32 of Disciplinary Regulation, diligently reviewed the following facts and evidence (attached in the file):
- Proposal of the Competition Commissioner, Ref. No. 183, dated 19.05.2015
- Report of the Kosovo Police, dated 19.05.2015
- Conclusion of the game commissioner, dated 19.05.2015
- The statement of the first referee, Mr. Ivan Milicevic dated 20.05.2015
- Statement of the referee, Mr. Faton Kurshumlija dated 19.05.2015
- Report of Mr. Art Gashi, President of BC “Peja” from Peja, dated 19.05.2015 and
- Statement of Mr. Erolld Belegu, President of KBF, dated 20.05.2015;
and based on legal provisions in force, finds BC "Peja" and the official representative of the club guilty for said violations.
The Commission also took into account Article 25 of the KBF Disciplinary Regulation, which pertains to mitigating circumstances.
Therefore, after carefully reviewing the evidence and in accordance with the applicable normative acts, the Commission concluded that BC Peja, on 18.05.2015, abandoned the playing court without any justification, leading to the deliberation as per the enacting clause of this decision.
Legal remedy: Parties dissatisfied with this decision, have the right of appeal to KBF’s Arbitration Commission within three days of the receipt of this decision.
